K\u00ebshilli i Konkurrenc\u00ebs i Rumanis\u00eb d\u00ebnoi dhjet\u00eb banka tregtare me gjoba rekord q\u00eb arrijn\u00eb 710 milion\u00eb euro n\u00eb total p\u00ebr vjedhje t\u00eb qytetar\u00ebve p\u00ebrmes fiksimit t\u00eb interesave t\u00eb kredis\u00eb. Sipas vendimit, bankat e kan\u00eb b\u00ebr\u00eb k\u00ebt\u00eb p\u00ebrmes koordinimit gjat\u00eb procedur\u00ebs s\u00eb p\u00ebrcaktimit t\u00eb norm\u00ebs referenc\u00eb ROBOR.<\/p>\n

Sipas autoritetit antitrust, institucionet e kreditit q\u00eb merrnin pjes\u00eb n\u00eb procesin e p\u00ebrcaktimit t\u00eb p\u00ebrditsh\u00ebm shk\u00ebmbyen informacione konfidenciale dhe strategjike, ve\u00e7an\u00ebrisht n\u00eb lidhje me \u00e7mimet dhe kuotimet, n\u00eb vend q\u00eb t\u00eb dor\u00ebzonin t\u00eb dh\u00ebnat e tyre n\u00eb m\u00ebnyr\u00eb t\u00eb pavarur.<\/p>\n

Bogdan Chiri\u021boiu, President i K\u00ebshillit t\u00eb Konkurrenc\u00ebs, deklaroi: \u201cVendimi yn\u00eb nuk kishte t\u00eb b\u00ebnte me rregulloret ose politikat n\u00eb sektorin bankar, por kufizohet ekskluzivisht n\u00eb sjelljen e bankave gjat\u00eb periudh\u00ebs s\u00eb fiksimit t\u00eb ROBOR dhe bazohet, sigurisht, n\u00eb konstatimin e nj\u00eb shkeljeje t\u00eb rregullave t\u00eb konkurrenc\u00ebs, jo t\u00eb normave t\u00eb tjera. Vendimi p\u00ebr sanksionim u mor unanimisht nga Plenumi i K\u00ebshillit t\u00eb Konkurrenc\u00ebs. Debatet e gjera publike para miratimit t\u00eb vendimit jan\u00eb t\u00eb pazakonta dhe kan\u00eb krijuar konfuzion, prandaj sqarimet jan\u00eb t\u00eb nevojshme.\u201d<\/p>\n

Gjobat<\/strong>
\nBanka e nd\u00ebshkuar m\u00eb ashp\u00ebr ishte Banca Transilvania, e cila u gjobit me 167.2 milion\u00eb euro. Banka Comerciala Romanau u d\u00ebnua me 110.2 milion\u00eb euro duke qen\u00eb n\u00eb vendin e dyt\u00eb, nd\u00ebrsa n\u00eb vendit e tret\u00eb ishte nj\u00eb bank\u00eb e pranishme edhe n\u00eb Shqip\u00ebri.<\/p>\n

Raiffeisen Bank u d\u00ebnua nga Autoriteti i Konkurrenc\u00ebs n\u00eb Rumani me 85 milion\u00eb euro p\u00ebr shkeljen e ligjeve t\u00eb konkurrenc\u00ebs. Nd\u00ebrkoh\u00eb dy bankat e tjera t\u00eb pranishme n\u00eb Shqip\u00ebri, OTP Bank dhe Intesa San Paolo u d\u00ebnuan respektivisht me 16.2 milion\u00eb euro dhe 5.4 milion\u00eb euro.<\/p>\n

Paralelisht, Konkurrenca u ka l\u00ebn\u00eb k\u00ebtyre bankave 60 dit\u00eb koh\u00eb t\u00eb eliminuar praktikat e paligjshme t\u00eb identifikuara.<\/p>\n

Vendimet e K\u00ebshillit t\u00eb Konkurrenc\u00ebs n\u00eb Rumani jan\u00eb t\u00eb zbatueshme, me gjobat q\u00eb shkojn\u00eb direkt n\u00eb t\u00eb ardhurat e buxhetit t\u00eb shtetit. Agjencia Komb\u00ebtare p\u00ebr Administrimin Fiskal (ANAF) zbaton vendimin sanksionues t\u00eb autoritetit t\u00eb konkurrenc\u00ebs dhe ekzekuton gjobat. Vendimi i autoritetit antitrust mund t\u00eb kund\u00ebrshtohet n\u00eb Gjykat\u00ebn e Apelit brenda 30 dit\u00ebve nga publikimi i arsyetimit t\u00eb tij.<\/p>\n

Bankat hedhin posht\u00eb gjetjet antitrust, njoftojn\u00eb ankesa ligjore.<\/p>\n

Bankat tregtare t\u00eb p\u00ebrfshira i kan\u00eb hedhur posht\u00eb me forc\u00eb akuzat dhe kan\u00eb njoftuar q\u00ebllimin e tyre p\u00ebr ta kund\u00ebrshtuar vendimin n\u00eb Gjykat\u00ebn e Apelit brenda afatit ligjor prej 30 dit\u00ebsh pas komunikimit zyrtar t\u00eb vendimit.<\/p>\n

Banca Comercial\u0103 Rom\u00e2n\u0103 l\u00ebshoi \u200b\u200bnj\u00eb deklarat\u00eb duke mohuar \u00e7do shkelje, duke theksuar se organi mbik\u00ebqyr\u00ebs i konkurrenc\u00ebs kishte hetuar m\u00eb par\u00eb mekanizmin ROBOR dhe ROBID dhe e kishte mbyllur \u00e7\u00ebshtjen n\u00eb vitin 2013 pa gjetur ndonj\u00eb shkelje t\u00eb antitrustit.<\/p>\n

N\u00eb nj\u00eb postim n\u00eb Linkedin duke reaguar ndaj vendimit, Omer Tetik, Drejtor Ekzekutiv i Banca Transilvania, paralajm\u00ebroi p\u00ebr pasoja m\u00eb t\u00eb gjera ekonomike: \u201cNe do t\u00eb luftojm\u00eb p\u00ebr t\u00eb v\u00ebrtetuar pafaj\u00ebsin\u00eb ton\u00eb dhe p\u00ebr t\u00eb treguar se BT veproi n\u00eb m\u00ebnyr\u00eb korrekte dhe ligjore. Vendimi i K\u00ebshillit t\u00eb Konkurrenc\u00ebs, n\u00eb lidhje me \u2018hetimin ROBOR\u2019, tregon nj\u00eb munges\u00eb t\u00eb thell\u00eb t\u00eb t\u00eb kuptuarit se si funksionon sistemi financiar dhe i rregulloreve n\u00eb lidhje me llogaritjen e ROBOR. P\u00ebr m\u00eb tep\u00ebr, vendimi i K\u00ebshillit t\u00eb Konkurrenc\u00ebs inkurajon populizmin dhe minon shanset e nj\u00eb rim\u00ebk\u00ebmbjeje ekonomike, gjat\u00eb nj\u00eb periudhe t\u00eb nd\u00ebrlikuar p\u00ebr vendin dhe ekonomin\u00eb, nj\u00eb periudh\u00eb n\u00eb t\u00eb cil\u00ebn sistemi bankar \u00ebsht\u00eb shtylla kryesore e stabilitetit ekonomik.\u201d<\/p>\n

UniCredit Bank e d\u00ebnoi vendimin si nj\u00eb akt administrativ t\u00eb p\u00ebrshpejtuar q\u00eb injoroi provat teknike t\u00eb paraqitura gjat\u00eb hetimit, duke deklaruar: \u201cQ\u00ebndrimi yn\u00eb \u00ebsht\u00eb i qart\u00eb: vendimi i K\u00ebshillit t\u00eb Konkurrenc\u00ebs \u00ebsht\u00eb i padrejt\u00eb, i pabazuar dhe ne e hedhim posht\u00eb at\u00eb me vendosm\u00ebri.\u201d<\/p>\n

Raiffeisen Bank Rom\u00e2nia argumentoi se hetimi nuk arriti t\u00eb zbulonte ndonj\u00eb prov\u00eb t\u00eb nj\u00eb marr\u00ebveshjeje t\u00eb qart\u00eb midis huadh\u00ebn\u00ebsve, duke theksuar rregullat strukturore t\u00eb tregut nd\u00ebrbankar. Huadh\u00ebn\u00ebsi deklaroi: \u201cNe shprehim mospajtimin ton\u00eb me p\u00ebrfundimet e K\u00ebshillit t\u00eb Konkurrenc\u00ebs dhe mbajm\u00eb q\u00ebndrimin ton\u00eb se ato nuk pasqyrojn\u00eb realitetet e tregut nd\u00ebrbankar dhe nuk marrin parasysh kuadrin ligjor n\u00eb fuqi, t\u00eb cilin bankat pjes\u00ebmarr\u00ebse n\u00eb sistemin e fiksimit ishin t\u00eb detyruara ta respektonin.\u201d<\/p>\n

Banka Qendrore neutrale: Presim gjykat\u00ebn<\/strong><\/p>\n

Banka Komb\u00ebtare e Rumanis\u00eb (BNR) mbajti nj\u00eb q\u00ebndrim objektiv pas njoftimit, duke sqaruar se vendimi antitrust nuk ndryshon ose ndikon n\u00eb kuadrin zyrtar rregullator q\u00eb rregullon tregun nd\u00ebrbankar.<\/p>\n

\u201cNga njoftimi p\u00ebr shtyp i K\u00ebshillit t\u00eb Konkurrenc\u00ebs kuptojm\u00eb se vendimi nuk synon rregulloren tregtare t\u00eb r\u00ebn\u00eb dakord nga BNR. Lidhur me praktikat antikonkurruese t\u00eb gjobitura nga K\u00ebshilli i Konkurrenc\u00ebs, kemi v\u00ebrejtur se bankat e konsiderojn\u00eb veten t\u00eb pafajshme dhe do ta kund\u00ebrshtojn\u00eb vendimin n\u00eb gjykat\u00eb. Gj\u00ebrat ndoshta do t\u00eb sqarohen gjat\u00eb rrug\u00ebs, n\u00eb gjykat\u00eb\u201d, tha Dan Suciu, z\u00ebdh\u00ebn\u00ebs i Bank\u00ebs Q\u00ebndrore t\u00eb Rumanis\u00eb.<\/p>\n

Para vendimit p\u00ebrfundimtar, zyrtar\u00ebt e bank\u00ebs qendrore kishin v\u00ebn\u00eb re se luhatjet n\u00eb norm\u00ebn nd\u00ebrbankare ishin t\u00eb lidhura ngusht\u00eb me menaxhimin e likuiditetit dhe vendimet e politik\u00ebs monetare.
